Go Dutch – Terms of Service (EULA)

1. Acceptance of Terms

By accessing or using Go Dutch, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

Go Dutch is a mobile application that enables users to split restaurant bills by:

• Scanning and processing restaurant receipts
• Assigning items to individual diners
• Calculating and splitting costs automatically
• Facilitating communication between diners
• Providing restaurant discovery and promotion features

3. User Accounts

A. Account Creation

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

B. Account Types

The App offers two types of accounts:

• Diner Accounts: For individuals splitting restaurant bills
• Restaurant Accounts: For restaurants listing their business and creating promotions

4. Auto-Renewable Subscriptions

Go Dutch offers auto-renewable subscription packages for bill-splitting functionality. By purchasing a subscription, you agree to the following terms:

A. Subscription Details

• Title: Go Dutch Split Packages
• Length: Subscriptions are available in packages of 1, 5, 10, 25, or 50 splits
• Price: Prices vary by package size and are displayed in the App at the time of purchase
• Auto-Renewal: Subscriptions automatically renew when you use all splits in your current package

B. Payment Terms

• All subscription payments are processed through Stripe
• Payment will be charged to your payment method at confirmation of purchase
• Prices are subject to change with notice
• You are responsible for any applicable taxes

C. Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• Unused splits in your current package remain available until expiration
• Refunds are handled in accordance with Apple's App Store refund policy and applicable law

D. Subscription Management

Subscriptions purchased through the App Store are managed by Apple. You can manage your subscription, including cancellation, through your Apple ID account settings.

5. Use of the Service

A. Permitted Use

You may use the App for lawful purposes only. You agree to:

• Use the App in accordance with these Terms
• Comply with all applicable laws and regulations
• Respect the rights of other users
• Provide accurate information when using bill-splitting features

B. Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Upload false, misleading, or fraudulent receipt information
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any portion of the App
• Use automated systems to access the App without permission
• Reproduce, duplicate, copy, or exploit any portion of the App

6. Content and Intellectual Property

A. Your Content

You retain ownership of any content you upload to the App, including receipt images and event information. By uploading content, you grant us a license to use, store, and process that content as necessary to provide the Service.

B. Our Intellectual Property

The App, including its design, features, and functionality, is owned by Go Dutch and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the App.

7. Disclaimers and Limitations of Liability

A. Service Availability

We strive to provide reliable service but do not guarantee that the App will be available at all times or free from errors. The App is provided "as is" and "as available" without warranties of any kind.

B. Bill Splitting Accuracy

While we use automated systems to process receipts and calculate splits, you are responsible for verifying the accuracy of bill splits. We are not liable for errors in receipt processing or calculations.

C. Limitation of Liability

To the maximum extent permitted by law, Go Dutch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

8. Indemnification

You agree to indemnify and hold harmless Go Dutch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion feature in the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Go Dutch operates, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
